The Nycto service is provided by Bigeyes Innovation Limited (hereinafter referred to as "we," "us," or "our"). Nycto is used to connect and manage multiple compatible night vision device products, providing you with features such as real-time live preview, video playback, video download, and OTA firmware upgrade. We value your privacy and will collect, use, store, protect, and disclose your personal information in accordance with this Privacy Policy.
This Policy is closely related to your use of the Nycto mobile application and related services (collectively referred to as "Nycto" or the "Services"). Please read and fully understand this Policy before using the Services. You have the right to refuse to provide information requested by us; however, refusing to provide information necessary for a specific feature may result in our inability to provide that feature to you or achieve its intended functionality.
1. Personal Information We May Collect
1.1 Personal Information
Personal information refers to information recorded electronically or in other ways that can identify a specific natural person or reflect the activities of a specific natural person, either alone or in combination with other information.
When you use Nycto, we may collect the following information depending on the specific features you actually use.
1.2 Information You Voluntarily Provide
When you register or use account features, we may collect your mobile phone number or email address, verification code, account identifier, nickname, and avatar to create and manage your account, verify your identity, and safeguard account security.
When you contact us or submit feedback, we may collect your contact email address, feedback content, and screenshots, logs, or other materials you voluntarily provide to handle inquiries, complaints, suggestions, and troubleshooting issues.
1.3 Device Connection Information
To identify, connect, and manage night vision device products compatible with Nycto, and to provide OTA firmware upgrades, we may collect:
- The SSID and BSSID of the Wi-Fi currently connected to your mobile phone;
- The night vision device's name, model, device identifier, firmware version, connection status, and firmware upgrade status;
- Your mobile phone model, operating system and version, application version, network type, and necessary device identifiers.
This information is used to confirm whether the mobile phone is connected to the Wi-Fi hotspot provided by a compatible night vision device, establish communication between the mobile phone and the night vision device, complete device authentication, assess compatibility, check for and install applicable firmware, and analyze connection or upgrade failures. Refusing to provide relevant information may prevent you from using night vision device connection, management, or OTA firmware upgrade features.
Depending on the connection method of the night vision device, real-time live video feeds, in-device videos, and related device data are typically transmitted directly via the local Wi-Fi connection established between the mobile phone and the night vision device. After connecting to this Wi-Fi, your mobile phone may display a prompt such as "No Internet Connection" or similar messages; this is normal for a local night vision device connection.
1.4 Real-time Live Feeds and Video Information
When you use real-time preview, video playback, or video download features, Nycto will read and transmit real-time video feeds, in-device videos, and their necessary metadata captured by the night vision device based on your operations. Downloaded videos will be saved to your mobile phone or other local devices according to your selection.
We will only access relevant content when you use the corresponding feature. Refusing to grant photos, media, or storage permissions may prevent videos from being downloaded or saved to your mobile phone, but will not affect real-time preview, in-device video playback, or other features that do not rely on such permissions.
1.5 Operational and Log Information
To ensure the normal operation of the Services, monitor anomalies, analyze and resolve malfunctions, and prevent fraud or abuse, we may collect IP addresses, application operational status, crash information, operation timestamps, and necessary operation records before and after malfunctions occur.
We will not collect information unrelated to Nycto's features solely for the purpose of improving services.
1.6 Location-Related Information
Certain mobile operating systems associate reading the SSID/BSSID of the currently connected Wi-Fi with location permissions. In such cases, Nycto may request location permission to confirm whether the mobile phone is connected to the Wi-Fi hotspot of a compatible night vision device.
Unless explicitly stated otherwise for a specific feature and authorized by you, we will not use this permission to continuously track your location or movements.
1.7 Information Obtained from Other Sources
Where permitted by applicable law and supported by a lawful basis, we may obtain information necessary to provide the Services from devices, service providers, or other third parties authorized by you. We will require information providers to confirm that they have the legal right to provide such information, and will use such information only within the scope of authorization or as permitted by law.
1.8 New Features
Nycto's features may be continuously updated. If newly added features require the collection of information not described in this Policy, we will explain the information collected, its purpose, and its usage through in-app prompts, updates to this Policy, or other appropriate means, and obtain your consent where required by applicable law.
2. How We May Use Your Personal Information
We may use the collected information for the following purposes:
- Creating, logging into, and managing your account;
- Identifying, connecting, verifying, and managing compatible night vision device products;
- Providing real-time preview of night vision feeds, playing back in-device videos, or downloading, transmitting, and saving videos according to your instructions;
- Providing customer support and responding to your inquiries and feedback;
- Monitoring and analyzing application anomalies, and diagnosing connection or operational malfunctions;
- Safeguarding account, device, network, and service security, and preventing fraud, abuse, and unauthorized access;
- Checking the model and firmware version of the night vision device, downloading, verifying, and installing applicable firmware, recording OTA upgrade status, and handling upgrade failures;
- Maintaining, improving, and optimizing the features, performance, and compatibility of Nycto;
- Fulfilling obligations under applicable laws or responding to requests from government, regulatory, judicial, or law enforcement authorities with lawful jurisdiction.
If we need to use your personal information for other purposes not directly related to the original purpose of collection, we will explain this to you separately and obtain your consent where required by applicable law.
3. Use of System Permissions
Depending on the device and features you use, Nycto may request the following system permissions:
3.1 Photos, Media, or Storage Permission
Used to save and view videos downloaded from the night vision device via Nycto.
3.2 Local Network or Wi-Fi Permission
Used to identify and connect to the compatible night vision device Wi-Fi hotspot currently joined by your mobile phone, and to transmit real-time video feeds, video files, or firmware data between the mobile phone and the night vision device.
3.3 Location Permission
Used to satisfy certain operating system requirements for location permission when reading the SSID/BSSID of the current Wi-Fi network. Unless otherwise stated and authorized by you, we will not use this permission to track your location.
You can revoke or disable the above permissions in your device's system settings. After disabling a permission, the corresponding feature may become unavailable, but other features that do not rely on that permission will not be affected.
4. How We Share, Transfer, and Disclose Personal Information
4.1 Sharing and Entrusted Processing
We do not sell your personal information.
The use of the app and the transmission of information received from Google APIs to any other app will comply with the Google API Services User Data Policy, including limited use requirements.
To provide data storage, message delivery, customer support, security assurance, or other necessary services, we may entrust service providers to process certain personal information. We require such service providers to process information in accordance with our instructions and applicable laws, and to adopt appropriate security and confidentiality measures.
We will not share your personal information with any other party except in the following circumstances:
- Where we have explained the circumstances to you and obtained your consent;
- Where necessary to provide services actively requested by you or to perform agreements with you;
- In accordance with applicable laws, legal proceedings, or requirements of authorities with lawful jurisdiction;
- Where strictly necessary to protect the life, personal safety, property safety, or other legitimate rights and interests of you, us, or others.
4.2 Transfer
In the event of a merger, acquisition, reorganization, asset transfer, bankruptcy liquidation, or similar transaction, your personal information may be transferred as part of such transaction. We will require the successor entity to continue protecting your personal information in accordance with this Policy and applicable laws; if the successor changes the original processing purposes or methods, it shall obtain the necessary authorization anew in accordance with applicable laws.
4.3 Public Disclosure
In principle, we will not publicly disclose your personal information. If public disclosure is truly necessary, we will inform you of the purpose and scope of the information to be disclosed, and obtain your consent where required by applicable law, unless otherwise provided by law.
5. How We Store and Protect Personal Information
5.1 Storage Location
Nycto provides services to users across various countries and regions. Your personal information may be stored and processed in countries or regions where we or our service providers operate facilities.
If cross-border data transfer of personal information is necessary, we will take necessary measures in accordance with applicable laws to ensure that the relevant information receives appropriate protection.
5.2 Storage Period
We only retain personal information for the period necessary to fulfill the purposes stated in this Policy, unless a longer retention period is required or permitted by applicable law.
Account information is generally retained until you cancel your account; operational and security logs are retained for the period necessary for troubleshooting, security assurance, and statutory obligations. Photos, videos, and other files stored on your mobile phone or other local devices are managed by you; uninstalling Nycto does not necessarily automatically delete these local files.
Upon expiration of the retention period, we will delete or anonymize relevant information in accordance with applicable laws.
5.3 Security Measures
We implement reasonable administrative, technical, and physical security measures—including access control, least privilege, transmission or storage protection, security audits, personnel management, and emergency response—to prevent personal information from unauthorized access, leakage, tampering, loss, or abuse.
In the event of a personal information security incident, we will take timely remedial measures and notify relevant authorities and affected users in accordance with applicable laws.
The Internet environment is not absolutely secure. Please properly safeguard your account, password, and verification codes, and do not disclose such information to others.
6. How You Manage Your Personal Information
Depending on the applicable laws of your country or region, you may have the following rights:
- Access your personal information held by us;
- Rectify or supplement inaccurate or incomplete information;
- Obtain a copy of your personal information;
- Delete your personal information;
- Withdraw previously granted consent;
- Restrict or object to certain personal information processing activities;
- Cancel your Nycto account;
- Lodge a complaint with a competent supervisory authority.
You may exercise these rights through the relevant settings within Nycto. If the application does not provide a relevant option, you may contact us by emailing appdeveloper@nycto.com.
To protect account and information security, we may require you to undergo reasonable identity verification. We will process your request within the timeframe prescribed by applicable law. If applicable law permits us to refuse a request, we will explain the reasons to you.
After account cancellation, we will cease providing services that rely on that account, and delete or anonymize relevant personal information in accordance with applicable laws. Account cancellation is generally irreversible; please back up any content you wish to keep before proceeding.
7. Updates to this Policy
We may update this Policy in accordance with service changes or applicable legal requirements. The updated Policy will be published within Nycto or on relevant pages and will take effect as of the specified effective date.
If an update materially affects your rights or the way your personal information is processed, we will notify you via in-app notifications, email, or other appropriate means, and re-obtain your consent where required by applicable law.
